These Terms of Use ("Terms") govern access to and use of the OffRail API, dashboard, documentation, and related services (together, the "Service"), operated by OffRail ("we", "us").
By creating an account or sending a request to the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and age
The Service generates and processes adult material. You must be at least 18 years old, or the age of majority in your jurisdiction if that is higher, to hold an account or send a request. By using the Service you represent that you meet this requirement.
You are responsible for ensuring that everyone you allow to use your API key also meets it. If you make the Service available to your own end users, you must operate an age assurance process appropriate to your jurisdiction before granting them access.
We may suspend an account at any time where we have reason to believe this section is being breached.
2. Accounts and API keys
You are responsible for the security of your credentials and for all activity carried out with them. Treat an API key as a secret: do not embed it in client-side code, public repositories, or anywhere it can be read by a third party.
Tell us promptly at contact@offrail.ai if you believe a key has been exposed. You remain responsible for usage incurred before you notify us and before we can disable the key.
One account may not be shared between unrelated organisations. We may require identity or business verification before enabling certain features.
3. The Service
OffRail is a routing layer. We accept your request, select an upstream provider capable of serving the requested model, forward the request, and return the result. We do not train models and we do not operate the models ourselves.
Model availability, pricing, capability, and behaviour are determined by the upstream providers and can change without notice. We may add, deactivate, or reroute a model at any time. We do not guarantee that a specific model, provider, or output characteristic will remain available.
The Service is provided on an "as available" basis. We do not commit to a specific uptime level unless we have agreed one with you separately and in writing.
4. Third-party model providers
Requests are served by third-party providers. Your prompts, uploaded content, and generated output are transmitted to the provider selected for that request, and are handled under that provider's own terms and privacy practices in addition to ours.
The provider serving a given request is identified in the response metadata, so you can see which one handled it. Write to contact@offrail.ai if you need the provider set for a model before you commit to it.
You are responsible for satisfying yourself that a provider's terms are compatible with your use. Where a provider prohibits a category of content, that prohibition applies to you through us, regardless of what these Terms otherwise permit.
5. Acceptable use
You may not use the Service to:
- generate, request, or distribute content prohibited under section 6;
- break any law that applies to you, to us, or to the provider serving your request;
- infringe another party's intellectual property, publicity, or privacy rights;
- impersonate a real person, or produce material presented as a genuine recording of a real person, without that person's documented consent;
- send another party's personal data where you have no lawful basis to do so;
- probe, scan, overload, or attempt to circumvent the Service's rate limits, credit gating, authentication, or content controls;
- resell or expose the Service in a way that hides the fact that generated content is synthetic, where disclosure is required by law.
We may apply rate limits, request inspection, and automated controls to enforce this section.
6. Prohibited content
The following are prohibited without exception. There is no permitted purpose, including research, testing, satire, or artistic intent.
Minors. Any sexual or sexualised depiction of a minor, real or synthetic. This includes material generated from an image of a real minor, material describing a fictional character as a minor, and material that presents an adult subject as a minor. We report suspected child sexual abuse material to the competent authorities and preserve the associated records as required by law.
Non-consensual material. Sexual content depicting a real, identifiable person who has not given documented consent, including intimate imagery generated from photographs of a real person. This applies whether or not the source image was public.
Coercion and trafficking. Content that depicts, promotes, or facilitates sexual violence, coercion, or human trafficking.
Bestiality and necrophilia.
Content that is unlawful in your jurisdiction or ours, including material that breaches obscenity, broadcasting, or distribution law where you operate.
An account used for any of the above is terminated without refund. Where the law requires it, we preserve and disclose the associated request records.
7. Your content and output
You keep whatever rights you hold in the content you send. You are responsible for having the rights necessary to send it.
As between you and us, you own the output generated from your requests, to the extent such output is capable of ownership. Generated output may not be original, may resemble output produced for another customer, and may not be protectable by copyright in your jurisdiction. We make no representation that output is free of third-party rights.
We use your content to operate the Service: to serve the request, to bill it, and to investigate abuse. We do not use it to train models. Retention is described in the Privacy Policy and is configurable on your account.
8. Credits, billing, and refunds
The Service is prepaid and usage-based. You buy credits; each request debits credits at the rate published for the model that served it. There is no subscription and no monthly minimum.
A platform fee is added to the amount charged when you buy credits, not to each request. The fee is shown in the checkout breakdown before you confirm. Cards issued outside the United States carry an additional processing surcharge, also shown before you confirm.
Published model rates come from the upstream providers and change when they change. The rate applied is the one in force when the request is served.
Credits are not money, do not earn interest, are non-transferable, and have no cash value. Purchased credits are non-refundable except where refund is required by law, or where a request failed because of a fault on our side and the failure is not reflected in your balance. Request a review at contact@offrail.ai within 30 days of the charge.
We may suspend service without notice where a payment is reversed, disputed, or fails.
9. Content complaints and removal
If you believe content generated or distributed through the Service infringes your rights, depicts you without your consent, or breaches section 6, write to contact@offrail.ai with:
- a description of the content and, where you have it, the request identifier;
- the basis of your complaint;
- your contact details;
- for a rights claim, a statement that you are the rights holder or authorised to act for them.
We aim to acknowledge within 3 business days. Where a complaint concerns non-consensual intimate imagery or material involving a minor, we act on receipt and do not wait for the review to conclude.
We may remove content, disable a key, or terminate an account in response to a substantiated complaint.
10. Suspension and termination
You may close your account at any time. Unused credits are not refunded on voluntary closure.
We may suspend or terminate access immediately where we reasonably believe you have breached section 5 or 6, where required by law, where a payment fails, or where continued service exposes us or an upstream provider to legal risk.
Sections 6, 7, 8, 11, 12, and 13 survive termination.
11. Disclaimers
The Service and all output are provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Service will be uninterrupted, that a given model will remain available, or that output will be accurate, appropriate, or fit for your purpose. You are responsible for reviewing output before you rely on it or publish it.
12. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.
Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the three months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
13. Indemnity
You will indemnify us against claims, losses, and costs arising from your use of the Service in breach of these Terms, from content you send, and from your distribution of generated output.
14. Changes
We may change these Terms. Material changes are announced on this page with a revised date, and where we hold your email address, by email. Continued use after a change takes effect constitutes acceptance.
